Our Mandate

2022 UPDATE: Our FAT IGA Trial in nada’s Federal Court of Appeal will be held in Vancouver BC on March 30, 2022.

On August 11, 2014 Plaintiffs Ginny and Gwen filed a lawsuit against the
FAT agreement in Federal Court of nada. See the original Claims.

We lost the Federal Court battle (Mactavish decision) and Appellants Gwen and Kazia are now appealing in nada’s Court of Appeal. A Notice of Appeal was filed on September 30, 2019 and a Memorandum of Fact and Law submitted in December 2020. nada responds to our arguments in February 2021. Federal Appeal Court trial and decision will happen in 2022.

Gwen and Kazia say that the nadian FAT turnover to U.S. IRS of private information of a subgroup of nadian citizens – made only beuse of threat of harm by the U.S. – violates the nada-U.S. Tax Treaty and nada's Charter of Rights and Freedoms.

We expect that this se will only be resolved in the Supreme Court of nada.
